Privacy Policy

Your privacy is important to us. Therefore, WICKS, Co., Ltd. (hereupon referred to as WICKS) has developed the following, appropriate Privacy Policy in order to protect our customers’ personal information.

Definition of Personal Information

Personal information is defined as any data or related information that can identify a specific individual (i.e., address, name, telephone number, e-mail address, and etc.). This includes any other information that will allow for an easy reference to information which may enable the specific individual to be identified.

Use of Your Personal Information

WICKS will use personal information explicitly provided prior (during registration) for collection purposes only. The following outlines the purposes in which we will use your personal information.

1. Billing for any fees incurred from our services according to the terms of service.

2. Application for our services, cancellations, sending confirmation e-mails in the case of changes pertaining to registered information.

3. Inquiries, confirmation of any information relating to questions about our services and as references for replies to customers.

4. To announce any improvement, new services, information pertaining to technical support, failure to provide any services, any information on maintenance, and etc.

5. As reference materials for the development of better services for customers. Specifically, by accumulating statistical information that cannot be linked to an individual based on the registered information.

6. In order to manage and provide our services to customers.

7. After receiving permission from customers prior, to provide information to a third party along with providing our services.

Limitations on Usage of Personal Information

WICKS will not use your personal information beyond which is stated under “Use of Your Personal Information” unless we have received permission from our customers beforehand. However, please be aware of the following exceptions.

1. Any matters concerning laws and regulations.

2. In the case that it is necessary to protect the life, body, or property of the individual, and it is difficult to obtain the consent of said individual.

3. In the case that there is a special need for WICKS to provide a third party with personal information in order to improve public health or promote healthy child development, and it difficult to obtain consent from the individual.

4. In the case that it is necessary for WICKS to handle personal information outside of its Purpose of Use in order to cooperate with national government, local government, or any person(s) entrusted with performing the functions prescribed by laws and regulations, and obtaining the consent of the individual is likely to interfere with the performance of those functions.

Retention Period of Personal Information

Your personal information will be stored only for the time period necessary to fulfill the purposes outlined in this Privacy Policy. After the purpose of use has been fulfilled, or after the retention period has expired, your personal information will be erased. However, this may not be the case according to situations outlined in Article 10, Paragraph 2 of the “Guidelines Regarding the Protection of Personal Information in the Telecommunications Business” as stated below.

1. When it is necessary to preserve the information in accordance with the provisions of laws and regulations.

2. When consent is obtained from the individual.

3. When there is a suitable reason for the telecommunication business not to delete the personal information, whereby the information is stored to the extent necessary for the execution of said business.

4. Other than reasons stated in number 3, when there are special circumstances or reasons to not erase personal information.

Management of Security of Personal Information/Supervision of Employees

WICKS takes the appropriate and necessary means to supervise staff and takes organizational, physical, human, and technical measures to manage security, prevent leakage, loss, and tampering of personal information.

Provision of Personal Information to Third Parties

We will not provide third parties with your personal information unless you give us consent to do so, other than as specifically set forth in this Privacy Policy. However, in the cases listed below in relation to laws and regulations, there will be instances where we will provide your personal information without your consent.

1. Any matters concerning laws and regulations.

2. In the case that it is necessary to protect the life, body, or property of the individual, and it is difficult to obtain the consent of said individual.

3. In the case that there is a special need for WICKS to provide a third party with personal information in order to improve public health or promote healthy child development, and it difficult to obtain consent from the individual.

4. In the case that it is necessary for WICKS to handle personal information outside of its Purpose of Use in order to cooperate with national government, local government, or any person(s) entrusted with performing the functions prescribed by laws and regulations, and obtaining the consent of the individual is likely to interfere with the performance of those functions.

5. When disclosing/providing information to business operators or contractors in order to conduct the services desired by customers.

Disclosure of Personal Information

We will disclose an individual’s personal information if requested by the individual to do so. However, we may not disclose some or any information in the following cases. If the decision has been made to not disclose some or all information, we will inform the individual.

1. In the case where the utilization of information to be disclosed would harm the individual or a third party’s life, body, property or other rights and interests.

2. In the case where there is a risk of significant interference to the proper implementation of our business.

3. In the case of violation of other laws and regulations.

Moreover, we will not, in principle, disclose any other personal information other than information such as access logs and etc.

Correction of Personal Information

If requested by the individual to correct, add to, or delete his/her personal information on the basis that the information provided is inaccurate, except in cases where special procedures concerning a correction etc. of the contents is prescribed by provisions of other laws or regulations, we will conduct necessary investigations without delay to the extent necessary, and depending on the results, will make corrections etc. of the contents of the retained personal data and notify the individual.

Suspension of Use

If requested by the individual to delete his/her personal information, for the reasons that the individual’s personal data, beyond the purpose of use as previously stated, was obtained via deceit or other improper means, we will conduct investigations without delay to the extent necessary and there will be a cease of usage or deletion of content depending on the results. We will proceed with the deletion of the contents of the retained personal data and notify the individual. This, however, shall not apply if the deletion of information requires a large amount of expenses and/or in the case that it is difficult to go through with deletion of content, and when necessary alternative actions can be taken to protect the individual’s rights and interests, we will go through with this alternative.

Questions Regarding Personal Information

We aim to deal promptly and appropriately with comments and/or complaints in regard to the handling of personal information.

Changes to the Privacy Policy

We will post information regarding any changes to personal information collected, purpose of use, or any other changes in the privacy policy on our website. The updated privacy policy will take effect from the revision date posted on the website.
